The use of magic mushrooms was legal in the Netherlands for a long time, but as of December 1, 2008, magic mushrooms have been banned. This means that the sale of fresh mushrooms containing psilocin and psilocybin is no longer allowed. The government made this decision because of the number of incidents reported, especially among tourists who suffered a bad trip.
Yet some products containing the same active ingredients are still legally available. This sometimes causes confusion because mushrooms are banned, but alternatives, however, may be sold. In this article, we explain why mushroom was banned and what options are still available.
Why are magic mushrooms banned?
The decision to ban magic mushrooms came after several reports of serious incidents. Especially in Amsterdam, there were cases of tourists panicking after using magic mushrooms, injuring themselves or causing dangerous situations.
The main problem with magic mushrooms is that the effects can be unpredictable. The active ingredient in magic mushrooms, psilocin and psilocybin, can have a profound effect on mental states. Users may experience intense hallucinations, but in some cases it leads to a bad trip with anxiety, paranoia and panic.
Due to the rising number of incidents, the government decided to ban the sale of magic mushrooms and other fresh mushrooms. This ban took effect Dec. 1, 2008.
Which magic mushrooms are banned?
The ban applies specifically to fresh magic mushrooms and other fresh mushrooms containing psilocybin. The sale of fresh magic mushrooms has not been allowed in the Netherlands since then.
Dried mushrooms had previously been banned under the Opium Act. Since 2008, Dutch authorities have now also banned fresh ones. This means that the trade in natural magic mushrooms has been completely stopped.
What is still legal?
Although mushrooms are banned, however, alternatives are available. Truffles, which grow underground and also contain psilocin and psilocybin, are not covered by the same ban. As a result, smartshops are still allowed to sell certain psychedelic products.
Truffles work in a similar way to magic mushrooms, but have a milder reputation. They are less likely to cause a bad trip, which is why the government has not placed them under the magic mushroom ban. As a result, sales of mushroom alternatives continue.

Because fresh mushrooms with active substances such as psilocin and psilocybin had too unpredictable effects, the government decided to ban the sale of fresh mushrooms.
