Magic mushrooms banned: all about the law
For when you really want to improve your life
Magic mushrooms, or shrooms, are known for their psychedelic effects and the substance psilocin and psilocybin responsible for their effects. In the Netherlands, however, these mushrooms are no longer legal.
In 2008, Dutch authorities banned the sale of fresh mushrooms due to concerns about safety and possible negative consequences of use. On this page you can read all about the ban, the reasons behind the decision and its impact on users and sellers.
Why are magic mushrooms banned in the Netherlands?
In 2008, the government decided to ban mushrooms because of a number of incidents in which users exhibited risky behavior. While many reported spiritual experiences and therapeutic benefits, there were also reports of psychological symptoms, accidents and even hospitalizations after using magic mushrooms. This led to a review of legislation and a total ban on the sale of fresh mushrooms.
The role of the substances psilocin and psilocybin
The active substances in magic mushrooms, psilocin and psilocybin, are responsible for the psychedelic effects. These substances affect the brain and cause visual effects, altered perception of time and space and profound insights. While some users see this as an enriching experience, for others it can be challenging and, in extreme cases, lead to a bad trip.
Consequences of banning magic mushrooms
The ban on magic mushrooms marked a major change for smartshops and users in the Netherlands. Before 2008, fresh magic mushrooms were easily available in smartshops, but with the ban, the sale of fresh magic mushrooms was completely stopped. Dried mushrooms were already illegal before, so the ban now applied to all forms of magic mushrooms.
Alternatives after the ban
After the ban on magic mushrooms, smartshops found a legal alternative in the form of fresh truffles. Magic truffles contain the same active ingredients as magic mushrooms, but because they are not technically mushrooms, they fall outside of the 2008 ban legislation. As a result, they remain legally available and still allow users to have a psychedelic experience without breaking the law.

Risks and preparation for safe use
Although truffles are legal, they still carry the same risks as magic mushrooms. For example, a bad trip can occur if a person feels anxious, takes too high a dose or is in an unsafe environment. It is therefore important to prepare well and have an experienced trip-sitter with you when you first use psychedelics.
Although mushrooms have been banned in the Netherlands since 2008, this does not mean that psychedelic experiences are no longer possible. Truffles offer a legal alternative and are still available in smartshops. For a safe and positive experience, it is important to handle psychedelics consciously and inform yourself well about the effects and possible risks.
